SEPARATE MAINTENANCE
Because of their beliefs and desires, many of the clients with whom we consult find separate maintenance to be a helpful tool. Separate maintenance was created by the legislature for spouses who find it too difficult or dangerous to live together, but they do not want to be divorced. Separate maintenance is a lawsuit very similar to divorce except for two principles.
First, if a separate maintenance case is finalized, all of the issues involving the children, assets, and finances are resolved just like they would be resolved in a divorce case, but the husband and wife remain married to each other. Because the marriage is not dissolved when a separate maintenance case is finalized, the husband and wife cannot marry another person. The second difference between divorce and separate maintenance is that if a separate maintenance case is filed, prior to finalizing the case either the husband or wife may convert the case into a divorce case by filing one additional document with the Court.
